What Are the Differences Between ITAR and EAR?

itar_logoITAR is mainly for military or defensive articles, but it also includes space related technology. ITAR is designed to regulate goods and technology designed to kill or defend against death in a military environment. This is because of the potential application for missile technology. EAR regulates the goods and technology that is designed for commercial use, but which could also have military applications.

The main difference between the two is that ITAR’s main purpose is to ensure US Security. This means that ITAR is under a strict regulatory regime which does not address commercial or research objectives. EAR is under a licensing regime which allows for competing interests and foreign availability and combines commercial and research objectives with national security.

ITAR and EAR both share steep civil and criminal fines for substantial penalties. A failure to comply with ITAR can result in civil fines of up to $500,000 per violation. Criminal fines in regards to ITAR violations can be up to $1,000,000 and 10 years imprisonment per violation. EAR violations have a maximum civil fine of $250,000, and criminal fines can reach a maximum of $1,000,000 and 20 years imprisonment per violation.
